SUMMER 2022 NICOTINE PRODUCTS Know the rules on nicotine products Strict regulations are in place for businesses that sell or make e-cigarettes Retailers and manufacturers of e-cigarettes and nicotine-containing liquids must ensure that the products they sell or produce comply with the Tobacco and Related Products Regulations 2016 (TRPR). Investigation of such sales is the responsibility of Trading Standards, and advice and guidance for businesses can be found on the Business Companion website. The TRPR outline minimum standards for the safety and quality of e-cigarettes and refill containers (e-liquids), and the information consumers must be given to make informed choices about their purchases. They also aim to protect children from starting to use these products. The Medicines and Healthcare products Regulatory Agency (MHRA) is responsible for implementing the majority of TRPR requirements, and for ensuring manufacturers and suppliers meet these. The regulations: n Restrict e-cigarette tanks to a capacity of 2ml n Restrict the maximum volume of nicotine-containing e-liquid for sale in one refill container to 10ml n Restrict e-liquids to a nicotine strength of no more than 20mg/ml n Require nicotine-containing products or their packaging to be child-resistant and tamper evident n Ban certain ingredients, including colourings, caffeine and taurine n Include labelling requirements and warnings n Require all e-cigarettes and e-liquids to be notified to the MHRA before being placed on the market.
